D.C. and Virginia all divide assaults into separate categories. Each state specifies the punishment for different categories of assault.

D.C. Assault Laws Code Details and Sentencing
Assault With Intent To Kill or to Commit First Degree Sexual Assault DC code §22-401 Minimum jail time of 2 years.
Assault With A Dangerous Weapon DC code §22-402 Up to 10 years in prison.
Assault With Intent To Commit Any Other Offense DC Code §22-403 Up to five years in jail.
Assault or Threatened Assault In A Threatening Manner DC Code §22-404 Up to 180 days in jail.
Aggravated Assault DC code §22-404.01 Up to ten years in jail.



Virginia Assault Laws Code Details and Sentencing
Assault and Battery VA code §18.2-57 Class 1 misdemeanor. At least 6 months, with 30 days mandatory confinement.
Assault (Hate crime) VA code §18.2-57 Assaulting someone due to race, religion, or nationality is a class 6 felony.
Assault and Battery Against a Family Member VA code §18.2-57.2 First conviction is a class 1 misdemeanor. Third offense is a class 6 felony.
